Account Deactivation on selling counterfeit inventory

Hi,

Need help with my Account deactivation. It was deactivated on selling counterfeit items. The notification says this:

Why did this happen?

We have taken this action because we believe that your account or a related account is engaged in sales of counterfeit inventory which violates intellectual property rights, and may have been used to engage in deceptive or illegal activity that harms customers and our store. To learn more please refer to section 3 of the Amazon Services Business Solutions Agreement (https://sellercentral.amazon.com/help/hub/reference/G1791).

My account has perfect health. There is no single complaint of any customer or any brand.

0 IP Violations or any type of violation. I provided all the requested documents like:

1. Supplier invoice

2. Bank statement showing purchase of ASIN

3. My ID and business documents.

4. Proof of delivery and commercial invoice.

5. Emails of supplier of order placing, shipping and confirmation.

I could not pass the virtual verification because there was a minor error in the address on supplier invoice and DHL proof of delivery was showing destination service area address not exact address. I submitted those documents again with all the necessary verification.

Its been 3 months since my account was deactivated. I have been trying everything by appealing and asking for help from different sources. What else can I do to reactivate my account? Please help guys

Let's try to unravel this for you --

You say 'supplier' but DO NOT say it is an AUTHORIZED wholesale source. You do NOT say that you have written authorization (an LOA) from the BRAND saying that you have permission to sell their items on Amazon.

You offer up emails from the supplier showing the order details and shipping info. Does that mean that these details were what they shipped to YOU or were you DROPSHIPPING and these are the details on what some unnamed source sent on to an Amazon buyer on your behalf?

And, again, proof of delivery to you or to the buyer?

Here is what it looks like --

You were dropshipping. You do NOT have an LOA. You used one of those TikTok/YouTube fake wholesalers that have thousands of brands in stock and are NOT authorized distributors for any of them.

Unless you have an LOA and an INVOICE from an authorized wholesale distributor you would normally be done in any case BUT

THIS IS YOUR THIRD POST about being suspended for dropshipping in the past 12 months.

Be sure to send a nice note thanking all the YouTube and TikTok producers that got you into this mess.

Forget it. That is the death sentence and there is no way of return.

Since on Amazon everybody has ONE chance in a lifetime, try to sell LEGAL products on another platform.

What proof do they have about its fakeness

The burden of proof is not on them to prove it's fake; the burden of proof is on the seller to prove that it is not.

It comes down to liability.

If you sell counterfeit items on Amazon, and Amazon has no reason to suspect you, then when you get into legal trouble, Amazon can legitimately claim plausible deniability. But once there is reason to suspect you, if they continue to allow you to sell, and it turns out to be counterfeit, then Amazon joins you in being liable for selling counterfeit.

They are not going to accept that liability without some way out, such as legitimate documentation of your supply chain. If you cannot provide that, why would they assume that liability?
