How Amazon started. Booksellers let's join together. AI is here and this will be even worse. Copyright and Trademark issues.

This is a long story. For the last 7 years Amazon has been suspending accounts with the unethical, immoral, unjusitifed, and senseless, contradictory fact that Amazon itself lists the same items that we list.

Ingram is the most important book supplier in the US, and possibly in the world, it's the first supplier Jeff used when starting Amazon. Without Ingram Amazon would not exist.

Amazon takes their catalog, similar to sellers like us, and similar to dozens of sellers like us, and list them in Amazon. Ingram has a catalog of 13 million items. Generally, sellers list 1 to 3 million, the best sellers.

To make it easy to understand as it's long, from this list of books, sometimes a rights owner comes and say a book infringes something, there's hundreds of cases. In some cases, they are correct in defending their brand or copyright, in some they are not.

However, there are two main things about this issue which we have been reporting in more than 100 calls since 2018, and even we received a call from the infringements and catalog department 2 years ago , asking us for more information on what was going on. Sarah Dub. , Jason Nog. are some of the people involved in this call.

This is very important: "They recognized in this call, which was recorded by Amazon, that booksellers like us are caught in the middle of this issue" And that they were working on an appeal process for booksellers so that this issue could be fairer, and accounts would not be suspended.

We worked with them to explain the above situation but it's now even worse with more frequent account deactivations.

There are two things we need to point here, and one request to the community.

1) Amazon lists the same items, we have screenshots as proof, lots of them , showing that Amazon itself listed the items. Meaning....that no one, not even Ingram nor Amazon can know in advance that a book will have any sort of copyright or trademark issue in the future. So the question we have been asking ironically to Amazon, is ....you wont suspend your own account of course right?

But if you cant know , even with your power of Arificial Intelligence which book infringes and list it too, why do you punish your sellers for it? How do you expect sellers to prevent this, if not even Amazon or Ingram can?

2) Amazon does not accept invoices from Ingram to remove the complaints. Why? As we explained, Ingram is the most important books supplier in the world and Amazon's own book supplier. If Amazon does not accept invoices for the supplier which founded their business, do you think other categories are at better position?

Lastly, this is a request to ALL booksellers here, whether big or small, let's join forces to write a letter to Amazon so that they change their policies, so that they consider that we are the middle man, (as they said in their call to us) and that we dont have any control over a 13 million books catalog, and it's possible future copyright or trademark infringements.

One more thing, which the top technology guys should think about:

------- How do you expect to protect booksellers if Artificial Intelligence will allow anyone to write a book, with any pre-fabricated content by computers, which may include any reference to any book, any brand reference etc.

The problem is about to get worse. -----

You may have the best system in the world for ecommerce, but if you can't handle a simple, basic, ethical issue like treating your booksellers right, then I am sorry to say, but you are not a good company and people working there in this matter are not good.

There are real persons here who invested 15 years selling here, with sons and daughters, with employees.

And due to very unfair company policy, again, a policy that your own company violates, you are leaving people with a lot of stress, worry, and without their income.

This is the rights owner's reply for one of the complaints the opened on all AMAZON marketplaces: Do you see AMazon? Rights owners want to collaborate but you make it difficult for all of us. The rights owner wants to remove the complaint against us, shouldnt there be that option on the form?

Here is his message:

"I very much empathize with your situation and feel terrible you are going through this. It sounds like you listed our pirated book because you relied on Ingram to have checked that it was authentic. Unfortunately Amazon sent us a letter that if we don't file a lawsuit in ten days they will reopen the ASINs meaning the sales can continue and it may impact our ability to file a suit. The publisher would just likely seek other ways to list them other than through Ingram.. The matter has been turned over to our attorneys now and they have advised us not to do anything about the complaints in the case.

I am sorry it has come to this, but Ingram has chosen not to respond to our emails from Tuesday. From what I am told it seems if we were to retract for you, we have to retract for Ingram and everyone else involved. Amazon should make this an easier situation to manage than sending and responding to case messages. There should be real time discussion about what needs to be done to help all sellers. We cannot retract for everyone as we have lost much more than 10K dollars in sales on Amazon alone.
