Compliance issue: Christmas Ornament determined to be a Toy (requiring testing and documentation)
All of our products are categorized as Seasonal Decor, Ornaments, hanging figurine ornaments or other ornaments. Presently one item is singled out by Product Compliance and despite 3 appeals has been determined to be a Toy requiring safety testing and documentation. It's has now been deactivated. The appeals have been based upon Amazon's own criteria of what makes a toy for a child under 12 years old, and CPSC governmental criteria and case study for what determines an item is a toy for a child under 12 years old. Additionally there is verbiage in the CPSC cases describing their philosophy that Seasonal Decor such as ornaments are not not considered a toy. Included in the appeal us US Customs' HS Code number naming it as Christmas Ornament (Not a Toy).
One issue is there is not enough space in the Appeal box in Seller Central to provide concise info to prove our case.
Seller Central is apparently not closely connected with Product Compliance, so they have not been able to advise.
Can anyone suggest a better way of approaching this subject in a future appeal?
