Can I sell a used book as "AS NEW" if it has a remainder mark?
The book is unread, the spine cracks when I start to open it.
It has a red marker mark on the bottom of the books when the pages are closed. I'm assuming that's a remainder mark, even most of them are black.
A new book could be remaindered. I'm selling it as Used, and describing the condition "As New".

No. It's not New -- it is used.
If you mean can you grade it as Used - Like New -- then I would advise NO. It's not like new. It has an ugly remainder mark. That's a flaw. A "Like New" book has no flaws.

You could grade it Very Good, and say that it's like new except for remainder mark.
