Brand vs private label vs generic
Hi There!
I am new to amazon fba, and i have seen alot of videos and read online before i came here.
i have these questions:
1. is there a way to register a brand name, without trademark or a pending trademark? as off what i have read, i think its impossible?
2. when you search a product and see "Brand: pamper" OR "vist the pampers store" just under the title of product. what is the difference in there, and how do i find out if a product have registered trademark/brand ? i know pampers have a trademark, but talking about any brand/store name you never have heard of before. how do i find that out?
3. after doing some research on jungle scout i found a good product. The product is listed under a brand, and have active trademark in USA. with only one seller on Amazon. The seller and brand name is not the same.
But when i go to add the same ASIN on seller account( add product), i dont need approval to sell. I can list that same product, without brand approval. How would that be possible if its a branded product. I only need sellers SKU. It is a product for babies.
My intention here is to sell products that are generic, on same listing, or make a better one. I dont want to hijack someone elses work, or get an IP voilation. This way i can gather some investment for my own private label.
Any help regarding my questions will be very helpful.

I can list that same product, without brand approval.
You cannot sell ANYTHING without Brand approval, in writing. Amazon does NOT give you brand approval, they assume you have that

Your intentions will get you suspended unless you spend a few hours reading forum posts and going through Amazon seller university. Creating a new listing for a product that already exists would be a violation of policy.

I'll look to respond to your questions in order, then provide some high level guidance as well!
1. You are correct that a trademark or pending trademark is required to register a brand with Amazon.
2. You can check with the US Trademark data base (USPTO).
3. Thanks for reporting you found a branded item that didn't require approval for you to list it. Authorization from the brand is always required, though the system may not request that Amazon be provided with that Letter of Authorization from the brand until later.
