25b pesticide exemption Issues

We are attempting to reinstate a pesticide product which is exempt from FIFRA regulation. Under EPA regulations in 40 CFR 152.25, there are six categories of exempt pesticides. Ours fits into 25b, pheromones and pheromone traps.

I'm trying to find out if Amazon doesn't believe pheromone traps are exempt from FIFRA, or if they have an issue with our label/listing content. There are plenty of similar product listings, openly declaring 'non-toxic' in their titles, bulletpoints and packaging, which is unequivocally illegal so I doubt the label or the product is the problem. It seems to be an AI flag with no humans willing to overturn. Can any mods help, please? The Case ID is 14691420221

@Glenn_Amazon you were able to assist another seller with a similar issue. Would you mind looking into our case and seeing if it can be resolved?

Hello @Seller_1duCae1TWoDKj,

Thank you for reaching out. I hope all is well.

"We are attempting to reinstate a pesticide product which is exempt from FIFRA regulation. Under EPA regulations in 40 CFR 152.25, there are six categories of exempt pesticides. Ours fits into 25b, pheromones and pheromone traps."

As you have mentioned, I understand that you are attempting to reinstate the pesticide products. IN order for the seller forums community and I to better assist, I would like to ask you a couple of questions.

Per our pest control products and pesticide policy, pesticide and pesticide devices must comply with FIFRA and applicable state and local laws unless they are exempted from FIFRA.

pheromone traps are exempt from FIFRA

Do you have documentation pertaining information that pheromone traps are exempted from FIFRA?

"There are plenty of similar product listings, openly declaring 'non-toxic' in their titles, bulletpoints and packaging, which is unequivocally illegal so I doubt the label or the product is the problem.

When a listing is flagged for restricted product, it can be flagged due to key words in the title, bullet points, or packaging. Such key words can be anti-microbial, bacteria, or infestation, etc. When appealing the violation, your next steps will be to edit the listing and removing the key words and provide documents showing the product is FIFRA exempt.

For further assistance, I have passed your information to the account health support team who may attempt to contact you by phone.

Please ensure all of your contact information is up to date so that our team may get in contact with you. If you have any additional questions or updates, please continue to share them here.

Best,

Cade
