NOW all you need to do is read the Forum for all the suspension notices from dropshippers that got caught doing things wrong and/or did not have an LOA from EVERY brand they were dropshipping.

Ten YEARS ago you could do this and be pretty safe. Five years ago you could do it but it was more risky.

With the changes to the laws by Congress as well as changes to policies by Amazon this is one of the most risky ways you can go to sell on Amazon. Even eBay is dropping sellers that only dropship.

You might be safer going and enlisting in the Russian military and being sent to the front lines with the Ukraine.

Per the drop shipping policy, your customer must understand and identify you as the seller of record. If the shipment does not identify you as the seller of record, or the 3rd party includes packing slips with their company information on it, this can confuse the buyer, which is strongly prohibited.

If you are hiring a 3rd party company for this purpose, here are the requirements:

  • Have an agreement with your supplier where you are the only seller of record and the only entity identified as the seller of your products on all packing slips, invoices, external packaging, or any other information included or provided in connection with the products;
  • Remove any packing slips, invoices, external packaging, or other information identifying a different seller or third-party supplier prior to shipping the order; and
  • Remain responsible for accepting and processing customer returns, and always comply to the: Business Solutions Agreement (BSA) and applicable Amazon policies.

If the above requirements are not met, this will be considered a violation of the drop shipping policy. I am unable to offer you my opinion on 3rd party companies, however, I hope the information provided about the drop shipping requirements will help you to make an informed business decision.

In addition to what @LeviDylan_Amazon has noted below, for Amazon, here is an additional risk that no one seems to pay much attention to caused by the infamous Inform Act ----

Amazon has hundreds of thousands of dropshippers and RA sellers (some that are dumb enough to have Walmart or eBay send items directly to Amazon buyers). For Amazon that can cause severe problems --

Directly from the law -- (emphasis added)

"(ii) Whether the high-volume third party seller used a different seller to supply the consumer product to the consumer upon purchase, and, upon the request of an authenticated purchaser, the information described in clause (i) relating to any such seller that supplied the consumer product to the purchaser, if such seller is different than the high-volume third party seller listed on the product listing prior to purchase."

In other words, if the AMAZON seller used a different seller to supply the consumer product to the consumer (COMMENT--dropshipped or RA direct from someone else) that seller MUST provide the information for the source of the items and the authenticity of such.

As to proving authenticity, again from the law --

Although the law doesn’t list specific verification steps, the methods the online marketplace chooses must enable it “to reliably determine that any information and documents provided are valid, corresponding to the seller or an individual acting on the seller’s behalf, not misappropriated, and not falsified.”

In other words, AMAZON will take whatever steps they feel necessary to protect themselves and avoid those $50,120 fines PER CASE, in addition to any penalties the STATES might go after.

Amazon can get kind of 'testy' if they get dinged so I would not be shocked if they were to go after the sellers and all their assets to recover any of those fines and penalties.
