Cosmetics Labeling non-English

I am the brand owner on Amazon for a cosmetics brand called Ziaja.
We are the the importer on record with the FDA for this brand in the United States.

The company is from Poland (Europe) and produces the same product in many languages including their home language of Polish.

Amazon Policy and FDA law requires Cosmetics be labeled in English for sale in the United States.

We have many sellers Illegally importing and selling our brand on Amazon detail pages that show our product in English but they ship product that is not in English.

I have done everything possible to fix this problem, Test Buys, reporting these sellers but Amazon does nothing when all they need to do is check the sellers stock!

I have contacted the sellers directly but they do not care of course. Some even arrogant to say “We are selling Fake product because it’s not in Polish Language” No respect for our country and our laws.

It’s a difficult situation because it reflects bad on us and our brand when a USA customer gets our product and can’t read it. Needless to say they are being sold product that is illegal for sale in the USA.

How can I get Amazon to take action on this situation? We have been a seller for over 10 years and grew the brand from nothing here. Now they are allowing this?

Why wouldn’t Amazon want to remove these sellers? Why do they allow them to continue to break the rules? Am I missing something here?

I don’t want to be so aggressive that Amazon just decides to close our listings.

What to do?

Amazon will not assist you in policing your distribution channels. They say that outright in Seller Help.

I recommend that you have a discussion with your lawyers.

If you have control of the listings then you can add photos of the product showing the English for the ingredients and the directions. Then when a product arrives using not English languages you can claim repeatedly that a different product then that on the listing was shipped. Repeated claims will effect their account and may get them suspended. Do not leave feedback, do not make threats in messages.

You can also send Cease and Desist orders to their addresses as listed on Amazon or the shipping origin on the package shipped to you and then actually start taking them to court. You will want a lawyer experienced with dealing with Amazon for this so that you do not get your own nose snipped off while doing this.

I recommend doing additional searches on the forums for methods that may help you. But ultimately it comes down to test buys or a lawyer.

Have you reported these Sellers to CBP & FDA, for illegal import and resale?

Do you have a trademark in the USA? If so, are you in Amazon’s Brand Registry?

If not, then your only option is to report to the USA authorities. You could enlist the aid of a USA based lawyer to copy the complaints you are filing to Amazon legal.
