Section 3 of Amazon’s Business Solutions Agreement Deactivation

Hi Everyone, I've been selling on Amazon for 4 years and now my account is deactivated, please see below email from amazon. Tried to appeal but no success, do you think it's deactivated for good or is there still hope ?

Never received any warnings from Amazon or buyers regarding ASINS that were at the end of this email. I think I got complains form competition. Please let me know if you have any suggestions

Thank you

yep see it everyday lots of sellers creating listing fro Brand X and they branding it as brand y this is a big No No Unfortunately Amazon is all about branding this is what people do not understand that's why you have to aply for permission to list most brands these days and require a letter of authorization from the brand owner.

today I was attaching to a listing for brand x and it was branded as Y and required a approval to attach to the listing and I had to submit invoices and I also send a letter of authorization explain brand x is owned by this company and brand y is not the authorized brand owner. I'm sure that person is dealing with the same issue he is now :)

It doesn't matter whether you created the listing or not. You had the ASIN in your store catalog, which is against the TOS and multiple policies. Because you also chose to get around the brand restrictions for the fragrances.

Somebody could not sell a certain brand so they made a listing with another brand then change the title to the brand they could not sell. You found their listing and list your item.

Amazon holds responsible all the sellers on a listing if the listing is fraudulent.

By the way, you did not post what they ask you to provide.

They may not release your funds if you do not provide what they ask for.

Hello @ESTELLE_NYC,

This is Emet from Amazon to help you with your concerns.

Your Amazon Seller account has been deactivated
You have items listed against an ASIN that is mis-branded, and is infringing on a third party’s rights.

Thank you for your post, I can see there was a concern with an ASIN that was misbranded, resulting in an infringement of a brand or rights owner intellectual property.

Typically, in this scenario you will need to provide proof that you were sourcing products associated to the brand you were listing against, do you have documentation to support you were sourcing the ASIN you used to sell the product?

You will also need a detailed explanation on why you were using this listing. Were you aware of these policies? Did you have a process to monitor and verify the listing details and information match the product you were trying to sell.

You will essentially need to identify why using this listing violated our policy, and within that information as mentioned above provide why it happened.

Once you’ve outlined the root cause of the situation, you will need to explain how you corrected the problem. Did you improve any broken or develop missing processes?

Finally, you need to outline what you new process will include to showcase how you and the business will manage these issues in the future, offering reassurance that there will not be any future or similar concerns.

I would suggest reviewing our responsible sourcing documentation request requirements, which provides specific guidance on our invoice requirements. I would also suggest reviewing our seller university video on how to create an effective plan of action, which provide more structured guidance on a plan of action to ensure you're providing enough supporting information.

Is there small dispute court with Amazon? In case they don't release my funds.

When there’s a deactivation of the selling privileges the funds are typically held for about 90-days if the issue remains unaddressed. You can email the disbursement team directly using Disbursement-Appeals@amazon.com. Please note that requests for funds prior to the 90-day mark may go unaddressed or you will receive a follow up notice advising to continue waiting for the 90-day time frame to pass.

Once you request your funds, you may need provide some additional information so monitor your notifications in seller central once you reach out to them to ensure that you're following up on the funds request..

The forums community and I are here to support you. Please let us know how we can help you from this point forward.

Emet.
