Trademark Infringement For Wrong Class

Hello,

Today one of our ASIN's (B0CMVXK3C2) got deactivated due to trademark infringement of the trademark "Water Magic". Here is the trademark info below:

Infringement type: Trademark

Trademark number: 5079851

Complaint ID: 15934133091

This ASIN is selling under the Toys&Games category and it is by all means a toy. The trademark that the complaining brand is only for the "stationary" class and the word mark is not trademarked in any other class.

When I try to appeal to the infringement claim, I can only acknowledge the violation or I am asked to submit a contract or an invoice. There is no direct appeal.

I opened a case (15940372881) but that also got the generic we don't have enough information answer.

I was able to review the ASIN and the case information that you provided and I found that the term "Water Magic" is found in your generic keywords and images that shows it is also on your product packaging. As this product is technically considered stationary due to the fact that it is material to be written on, this can be considered misuse of the trademarked term.

To address this you must provide proof (letter of authorization) that you have the rights to utilize "Water Magic" in the listing and on the product. You must provide this proof via the appeal button next to the violation on your account health page.
