Listing removed - incorrectly identified as a medical device

Good day!

After two and a half months of going back and forth with amazon with case # 14547933121 we have not gotten a solution. Amazon INCORRECTLY categorized our product as a medical device. Despite all efforts and documentation proving that is not a medical device, and even clear information from the FDA showing that our product is exempt for the 510(K) certifications (with exact name and description of the product showing on the FDA) we have still not gotten a solution.

If anyone from the support team reads this, please take a look at this issue.

Such things are identified by the bots as "medical device" according to YOUR WORDING in the listing. The bots don't know your product, they just read your description.

What would I do? On your place I would take a new UPC from GS1 and create a new listing avoiding words that could lead to a "Medical Device Identification". Then I would wait two weeks to see if the bots are alerted. If not, I would then send in a small quantity to test. If anything goes well, only then I would send a bigger quantity.

You can go back and forth with seller support and prove whatever you want: they will never change the oppinion and reinstate THAT listing as it is. And you cannot edit a suspended listing.

What's the product? Are you using language in the title, description, bullets or metadata that may lead Amazon or customers to believe it's a medical device?

Are any competing products registered in the FDA's 510k database? If they are, and yours is not, Amazon may determine that ANY such product requires an FDA certification.

You can search the FDA 510k database to see the other companies that have done this successfully, as well as the relevant classifications and standards.

Welcome to the wonderful world of Amazon. Their bots are busy destroying honest brands business whilst helping the counterfeiters and grey market sellers.

Perhaps everyone should do the same to their products like Prime TV, Whole Foods, Happy Belly and Wag and see how they like it when fully compliant products are wrongly accused of being illegal medicines.

I am pretty sure if they had to spend the rediculous amount of time that Amazon Sellers do when responding to absolute nonsense claims.

I spent three weeks arguing with Amazon ovr an absurd claim than one of my products contained prescription doses of Hydroxy Quinone when the product does not even have hydroxy quinone in it.

I dont know where they get off deliberately sabotaging the sellers business and then charging them bsurd fees for the priveledge of selling on their platform.

I am seriously investigating whether or not I can take legal action against them for the damage they are causing (not to mention the stress they put me under )using their platform
