Two New Hijackers overnight on a NEW listing
Case ID 15660893791 with seller support
I cant believe I have to be one of those people to post on the forum about Amazon not helping or preventing issues...
I am a new brand on Amazon, Started selling my product roughly a month ago, I have been spending a good amount of money on advertising to build the listing and get reviews to build up my listing for sales "Obviously im in the negative" I have sold roughly 18 Units to date, and over night 2 new sellers are now listed on my product
I sell my product for $24.95
Names of the new sellers for my Branded product on Amazon you ask?
金疙瘩商贸 offer at $20.06
and
Kushghana - offer at $110
Luckily I still control the buybox at my pricing for the time being...
But with Amazon telling me over the phone, there is literally "Nothing they can do because your trademark is still pending" that means I have to wait for the next 4-5 months while I wait for my trademark to finalize. In the mean time, these sellers can sell the product using their listing, and review bomb my listing and keep me from getting any sales from here on out till my trade mark is finalized. ANYONE IN AMAZON PLEASE HELP AND PREVENT THIS ??????

Is anyone in amazon able to help me get these sellers removed for counterfeit products? My customers are going to think its my product if they do purchase from them and leave bad reviews for the wrong product.

Hello @Seller_SwWZmVVRqnFVK
My name is Sandy from the Amazon Community Manager team. I looked into the case number you have provided and the ASIN details.
First, I would like to state that Amazon's policies allows any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.
In addition, Amazon respects a manufacturer's right to enter into exclusive distribution agreements for its products.
In this situation, the 2 sellers you mentioned are listing on your ASIN as Amazon policy allows. However, in the case you mention "These are obviously counterfeit sellers, since I do not sell to any 3rd parties, I ONLY sell my product on Amazon."
If you have manufacture rights and distribution rights on this product, please attach those documents to seller support. If you claim these sellers are counterfeit, without valid proof Amazon will not take action.
Here are some steps I would recommend for you to take with a pending trademark:
1. Provide manufacture rights and distribution rights on this product.
2. Complete test buys for the product from these sellers. Test buys are standard process throughout the world for rights owners to perform checks to see if their IP is being illegally used. If your IP (trademark) is still pending, you can still submit through the Report Abuse form, and select "Products received are different than the description on the detail page."
It is VERY important to mention only facts while doing this. For example, material differences, size differences, etc. I have seen many sellers tend to get emotional (it is understandable) and do not state facts on why the product is different then described.
Please let me know if you have any questions.
Best,
Sandy
