Amazon Refusing to Reinstate a Product Because of a 10 Year Old Issue

We have a client whose brand was flagged by the FTC almost 10 years ago now for how they were marketing the product off of Amazon. When we are requesting the ASIN be reinstated, we are getting the following response:

"This product has been identified as a **brand name removed** product that makes a prohibited claim. Products that make prohibited claims are not allowed for sale or listing on Amazon. For additional information, please see: **link removed**"

The link references an article that talks about a settlement that was reached with the FTC. The brand has changed ownership twice since then, and has been in compliance since this one infraction and Amazon has allowed every other product to be listed and the brand to registered through Brand Registry, yet they are telling us they are refusing to reinstate this item because of a 10-year-old issue which no longer applies to the brand or the owners of the brand.

Really need moderator assistance on getting this matter resolved. since we have exhausted all other avenues of resolution. Just to be fully clear, this issue has absolutely nothing to do with any content that is currently posted on Amazon. They are saying the brand itself is flagged and cannot be sold, yet the brand has a selling account, is selling multiple other products, and is owned by another company now. It makes no sense.

If you have opened any cases provide a number so any MOD that happens to drop by can look it over to see if they can help.

Without a case number in the posts it wastes time for everyone. I no longer tag anyone if there is no case #.

They have to ask for it and then wait for a reply from the poster and then the poster has to wait again for the MOD to find the case, and then more waiting.………

Thank you for reaching out with your concerns. As mentioned by @Seller_kIukTwdhvntAp in general we will need a Case ID from the Brand Owner to review and try to appeal an issue like this further. You will want to make sure that the request comes from the Brand Owner themselves. If you don't have a Brand Registry Role, it may be difficult for you to appeal on their behalf. Once you provide additional information I can see what escalation options, if any, exist. Please know that Amazon makes the final decision if a product is allowed to be sold on Amazon websites.
