Trademark Pending

My question is why Amazon is accepting a trademark that is still pending. Every time i call for help they say its live and they leave the word pending out. Pending trademark should not be accepted until is registered that why we can't even appeal the trademark because still waiting for the examiner decision but no Amazon knows better than everyone, the attorney that said no we have nothing to do until after the examination, the trademark assistance also confirmed that does not mean anything need to be approved by the examiners first, A seller that is misleading everyone by trademarking an ingredients with what we make skin care and makeup. so many sellers are selling the product with the ingredients all of them are still on Amazon he is only after my business and Amazon are allowing this by taking all my listing for years down and not even checking my appeals.

You have mentioned in your post "why we can't even appeal the trademark because still waiting for the examiner decision", are you trying to appeal the trademark use through uspto or do you have violations on your account and you are trying to appeal those?

Per our intellectual property policy for sellers, all sellers must comply with all federal, state and local laws and amazon policies and may not violate the IP rights of brands or other rights owners. The 3 main types of IP rights are copyright, trademark and patent.

Based off of the information you have provided, I understand that the trademark is pending. However, if you have received a trademark violation on your account, you will need to reach out to the rights owner for a retraction or provide supporting documentation such as a letter of authorization or a licensing agreement, if you have a "trademark on product", invoices are accepted. However, if you have a " trademark on product detail page" invoices are not accepted.

Letter of authorization and licensing agreement requirements are:

  • 'Licensor'–The company/brand providing the rights to intellectual property
  • 'Licensee'–The company/brand receiving the rights to use the intellectual property.
  • ‘Grant’–The intellectual property being licensed and the scope of rights granted
  • ‘Geographic Scope’–The specific territory or territories where use is authorized (may be worldwide)
  • ‘Term’–The duration of the authorization (may be perpetual)

Invoice requirements are:

  • Must be issued in the last 365 days
  • Must match the sales volume in the last 365 days
  • Must have your supplier’s information such as their name, address, phone number and email address
  • Must have the seller’s information that matches the information in seller central when you registered to sell
  • Upload the documents in pdf, png, gif, or jpg
  • Your documents should be able to trace your products to the original manufacturer even if you did not purchase them directly from the original manufacturer. This may require requesting additional invoices or supply chain documentation from your supplier if you are not sourcing directly from the manufacturer.
  • You may remove pricing information, but the rest of the document must be visible to enable adequate review of the documents you provide. For ease of our review, you may highlight or circle the ASIN(s) under review.

Invoices are going to demonstrate where your products are produced or manufactured
