I need Mod help escalating my case please.

My case ID is 14968267301. I am a used book seller and have been selling on Amazon for 3 years. I recently received a authenticity policy violation for a counterfeit book claim. Obviously my book is not counterfeit, and I'm trying to rectify the issue with support. They have moved over 1,500 books to stranded and now they are all restricted. I have submitted the original receipt along with a letter that the library book store wrote for me stating that I purchased the book from them, but that has not helped. As a used book seller there is very little documentation that I can provide, so I'm asking for help with being connected to a person in support that actually understands the issue and will resolve it instead of providing the standard submit these documents that don't exist answers.

I understand there have been concerns regarding the authenticity of one of your products for which you have received an violation. I would like to provide insight into the applicable policy as well as provide resources for you to utilize as you move forward.

Product authenticity is often viewed in the same regard as intellectual property, as the authenticity of an item often involves a brand or trademark. While all sellers must follow all applicable local, state, and federal laws alongside Amazon policies, the questions of authenticity of items offered and sold on Amazon will always be taken seriously. Overall, it is not only an attempt to respect the rights of a rights owner or brand, but to maintain the trust buyers have knowing they can find exactly what they are looking for and all information provided be accurate.

Amazon also maintains a strict anti-counterfeiting policy. Amazon strives to ensure a trustworthy shopping experience for our customers. By selling on Amazon, you agree that:

  • The sale of counterfeit products is strictly prohibited.
  • You may not sell any products that are not legal for sale, such as products that have been illegally replicated, reproduced, or manufactured
  • You must provide records about the authenticity of your products if Amazon requests that documentation

The violations received in regards to such a complaint are designed to verify the source from which a seller, such as yourself, has utilized to obtain their products. This is going to be done by verifying any sourcing documentation you have and enables Amazon to verify the information on those documents. Listed below are the requirements for sourcing documentation request:

  • Copies of invoices, receipts or other similar documents that demonstrate where your products are produced or manufactured

These documents:

  • Should reflect the sales volume of your product across all Amazon marketplaces in the last 365 days
  • Should demonstrate your product’s full supply chain
  • Should include contact information for the supplier(s) and the original manufacturer. We may contact suppliers or manufacturers to verify the documents
  • Your documents should be able to trace your products to the original manufacturer even if you did not purchase them directly from the original manufacturer. This may require requesting additional invoices or supply chain documentation from your supplier if you are not sourcing directly from the manufacturer.
  • You may remove pricing information, but the rest of the document must be visible to enable adequate review of the documents you provide. For ease of our review, you may highlight or circle the ASIN(s) under review.

I do understand you are a re-seller of used books. I do not want you to think I am discrediting the types of products that you choose to supply. However, the above standards and policies have been set forth as this is how Amazon chooses to verify the authenticity of their items.

Looking into the case ID provided, I see you have provide a receipt and a letter from your source. As your source has stated in said letter, they receive the items via a donation-based method. This creates an issue in terms of verifying the supply chain of an item. When verifying the supply chain of items, a strong sense of connection to the rights owner or brand will be present. The type of receipt and source you have utilized makes it more difficult to trace this, disabling Amazon making that verification.

Is there any other information you could possibly receive in regards to proof of authenticity for this book?

It is important to also consider the type of violation and potential ways this complaint occurred. If this is an intellectual property complaint, these are generally going to be submitted by rights owners. If this is a product authenticity customer complaint, have you located or received any direct complaints from any of your buyers?

There are more resources for authenticity violations available for consideration.

I understand I have provided a great amount of information here, so I would like to provide you time to look over and consider it all. Please continue to ask questions and provide relevant updates here, as the Forums community and I are here to support you.

All the best,

Stevie

I am wondering how Amazon can demand itemized invoices for used books. Central to the legality of reselling used books is the First Sale Doctrine, a fundamental principle of copyright law. This doctrine allows individuals to resell lawfully acquired copies of copyrighted works without the copyright owner's permission. As long as the books were legitimately purchased or obtained, sellers have the right to resell them, irrespective of whether they possess itemized invoices.

Has a major publisher sued Amazon recently? This seems to be an expanding and troubling issue.
