Mod please help with this frustrating Safe-T claim

Customer ordered and received a new, factory sealed CD. Customer returned an opened, used CD with scratches on the disc and a crack in the case. Please refund $4.38 for the return label and $7.45 for the damage. $7.45 is 50% of the item price. The CD is no longer sellable. Thank you
I provided photos. I was told that

The issue that you reported is not covered by the SAFE-T policy
This, of course, is not true, it is one of the reasons for opening in pull down menu, the item is materially different.
I sent more photos and copied and pasted Amazon's policy. I got the same cut and paste response 3 times and then the "we stand by our decision".
They sent a link to Amazon's policy and the very thing they are denying is listed as a cause for a refund. I pointed this out. I don't know if a human ever looked at my case, all of the replies were the same cut and paste.
Please help.
