Policy Violation warning - Barbie look alike font

Hello!

I received a policy violation warning some weeks ago, related to 2 of my ASINs. I deleted the products and the problem magically fixed itself (although I learned from my ticket reply that is not normally the case). My account health is good, I have no violations. But I am trying to understand exactly what flagged the system so I do not make the same mistake again.

My 2 products use a font similar to the Barbie one, called "Bartex". I am the maker of the design and have ways to prove this. I use Printify for fulfilment. I have not included the word "Barbie", "Mattel" or anything similar on the product description, so I am sure it is the design that actually made Amazon flag my product.

Can someone point me in the right direction here? If I upload these products again, am I going to be in trouble? If I upload other products that will use the same font, am I going to be in trouble?

TIA

If Mattel comes after you they're going to make Amazon look like the nice guys.

You don't have to use the actual trademarked word to be guilty of infringement.

Hi @Seller_Uhx1rllV622QQ,

Steve from Amazon here, thank you for reaching out. In this situation, you will want to refer to the performance notification sent when the action was taken against the ASIN. This will advise why the action was taken and the steps that can be taken to correct the issue.

If you believe there has been an error, please submit an explanation through your Account Health page and follow the instructions provided. Your explanation should include the following information:

1. A letter of authorization or licensing agreement proving that you are authorized by the rights owner to create and list products using trademarked term in relation to your product. The documentation submitted must meet the following criteria:

  • The document includes name and address of rights owner.
  • The document explicitly authorizes you to make and list products using the rights owner’s trademark, under your own brand name.

2. An explanation and any evidence or documentation demonstrating how the listings do not violate our intellectual property policies.

Please reference the below resources for more information on our intellectual property policies.

Intellectual Property Policy for Sellers

Respond to an intellectual property (IP) policy violation

Please let me know if there are any other questions.

Thanks,

Steve
