Image Copyright Infringement Appeal
Last week we're hit with Copyright Infringement product non-compliance. We have submitted an appeal, and it has been waiting Amazon decision for days. We opened Amazon case for this issue, Case ID: 15118747461
Amazon support mentions it's waiting internal team approval, they do not have any information on it. When we applied appeal, we were told up to 3 days. It has been way more than that. We're hit with 3 other product infringement case on same ASIN, and same category. We're currently waiting on Amazon's response to one of them to take further actions accordingly.
Could a mod please look into this matter, why is internal team not reaching resolution, why is Amazon Support not able to communicate between us and the internal team. This process should be more simplified and transparent, hope we can receive feedback on it.

Hi @Seller_11OSEBUHQVy8a,
Thank you for your post. I understand you are dealing with a copyright issue.
I understand you have a submission currently under review. Please be aware that we cannot guarantee a time frame for the completion of this review. The three days was given as a guideline but may take longer.
If you are submitting from the US marketplace, you will need to either request a retraction from the rights owner, or send in a DMCA. Once a DMCA has been submitted, the rights owner will have up to ten business days to respond to the document. If you are submitting documentation outside of the US marketplace, we would still need to allow the review team to complete their investigation prior to taking further action.
While going through this process, please monitor both your Account Health and Performance Notification pages for further updates as they become available.
Please feel free to reach out with any further questions or account updates, and we will assist you as best we can.
Regards,
Troy

Hello @Troy_Amazon
Recap: We submitted a letter for Counter-Notification as authorized in § 512(g) of the DMCA. This was submitted via Amazon's Listing Violation Platform under the section of appeals.
Amazon's update on the submission: "We completed our evaluation of your submission. We do not have enough information to remove the violation at this time"
Please suggest what went wrong and if internal team could review again. As far as our corporate is concerned, the counter party has NOT FILED A LAWSUIT IN RESPONSE TO OUR COUNTER-NOTICE. According to Amazon, THE COMPLAINING PARTY HAS UP TO 14 DAYS FROM RECEIPT TO FILE A LAWSUIT IN RESPONSE TO YOUR COUNTER-NOTICE.
It has not been 14 days since our initial counter notice, which happened on April 10th. Today is April 21st. So how is Amazon deciding that 'We do not have enough information to remove the violation at this time'? Does this mean we should reapply after 14 days is completed? 14 days or 14 business days? Even then, if Amazon needs to wait 14 days for complaining party's response, why did Amazon resolve this appeal? Shouldn't Amazon wait for resolution?
This is "Guilty until proven innocent" situation. Even then, when will you ultimately find us guilty.
What I am requesting to know: 1) Possibilities of why appeal denied. 2) Possibility of what needs to happen to fix this
Thank you for your reviewing this and your time!

Hello @Seller_11OSEBUHQVy8a,
Thank you for your response.
Have you received this information through a performance notification or is it on the violation page?

When a DMCA counternotice has been filed, it may take up to between ten to fourteen days for the review and the rights owner to respond. On your account health page, it may shows as the review has been completed. However, this type of review is very unique from others and just because it says the evaluation is completed or submit new information, does not mean the DMCA counternotice has been denied. After the counternotice has been reviewed, you should receive a performance notification or a case log providing the results of the counter notice. In the mean time, please monitor your account, performance notification and case logs. Once you have received communication of the results, please share the information here in this thread after removing personal information.
Best,
Cade

@Cade_Amazon@Troy_Amazon thank you for responses.
It's just on violation page, I did not receive any information or even confirmation that the evaluation is completed. Just decided to check through the page to find this out.
Today now marks end of full 14 days, the case is still same:
":We completed our evaluation of your submission. We do not have enough information to remove the violation at this time"
Again, asking same question, if we have submitted DMCA and now that it has been full 14 days for the oppose to respond and they haven't responded, then how can you still mark that we have done "Copyright Infringement"
Truth is we have not. This is not fair to us, we're targeted for no reason. Please advise what to do in this case. Thanks

It has been 2 days since I have requested a response. No response yet. Someone please help us! What to do! We sumitted DMCA already. It has been 14 full days since we submitted DMCA, amazon has denied our appeal. Should we reappeal?
Why are we being punished by Amazon if we did nothing wrong, which is confirmed by no reponse on DMCA. This is unfair, unjust. Someone help please.

Hello @Seller_11OSEBUHQVy8a,
Thank you for providing further information for us to review.
I would like to ask a few follow-up questions so that I can assist you the best. Which day did you receive the violation? From there, which day did you submit the DMCA counter-notice? Please note: the exact day you submit the counter-notice may not be the day it was accepted to be processed. If you have not received a follow up notification about the counter-notice specifically, the process has not been completed as of yet.
If you have submitted the counter-notice on April 10th-12 business days has passed since then (excluding the 10th), and you would have to wait the few additional business days for the process to be completed.
I suggest to monitor your notifications for the follow-up information regarding this and please feel free to update this thread once you receive a resolution or if you have any further questions. The Forums community and I are here to support you.
Wishing you the best,
LeviDylan
